City Code

                    Sec. 8-4.  Burning leaves, garbage, brush, etc

                        Persons are prohibited from setting fire to or burning brush, leaves, garbage,      or other materials of any kind on any street, street right-of-way, alley, or alley right-of-way, whether paved or unpaved,

                        within the city limits.

                    Sec. 8-3.  Uniform Fire Code adopted.

                        The latest adopted edition of the Uniform Fire Code is adopted by

                        reference as if set out at length in this section.

Uniform Fire Code

Sec. 11.203. (A) General. Open burning shall be conducted in accordance with this section. Open burning shall also be conducted as required by other governing agencies regulating emissions.

Exception: Recreational fires shall be in accordance with Sec. 11.204.

(B) Notification. Prior to commencement of open burning, the fire department shall be notified.

(C) Material Restrictions. Open burning of rubbish containing paper products is prohibited.

(D) Time and Atmospheric Restrictions. Open burning shall only be performed when time and atmospheric conditions comply with the limits set forth in the open burning permit.

(E) Location. Open burning shall not be conducted within 50 feet of any structure or other combustible material. Conditions which could cause the fire to spread to within 50 feet of a structure shall be eliminated prior to ignition.

Exception: Clearance from structures and other combustible material is allowed to be reduced as follows:

1.     Not less than 15 feet when burning is conducted in an approved burning appliance.

2.     Not less than 25 feet when the pile size is 3 feet or less in diameter and 2 feet or less in height.

(F) Fire extinguishing equipment. A garden hose connected to a water supply or other approved fire extinguishing equipment shall be readily available for use at open burning sites.

(G) Attendance. Burning material shall be constantly attended by a person knowledgeable in the use of fire extinguishing equipment required by this section and familiar with the permit limitations which restrict open burning. An attendant shall supervise the burning material until the fire has been extinguished.

(H) Discontinuance. The chief is authorized to require that open burning be immediately discontinued if the chief determines that smoke emissions are offensive to occupants of surrounding property or if the open burning is determined by the chief to constitute a hazardous condition.

 

Recreational Fires

Sec. 11.204. (A) General. Recreational fires shall be in accordance with this section.

(B) Location. Recreational fires shall not be conducted within 25 feet of a structure or combustible material unless contained in a barbeque pit. Conditions which could cause a fire to spread within 25 feet of a structure shall be eliminated prior to ignition.

(C) Fire extinguishing equipment. Buckets, shovels, or garden hoses shall be readily available for use at recreational fires.

(D) Attendance. Recreational fires shall be constantly attended by a person knowledgeable in the use of fire extinguishing equipment required by this section. An attendant shall supervise a recreational fire until such fire has been extinguished.

(E) Discontinuance. The chief is authorized to require that recreational fires be immediately discontinued if such fires are determined by the chief to constitute a hazardous condition.
